General conditions
• Terms of sale work in connection with arisen upon purchase of goods of the rights and duties between clients of FRAGRANCEGALLERY Interenet-shop (further the Client) and FRAGRANCE GALLERY OU (further Fragrance.ee).
• Conditions of this contract and the rights following from legal acts of the Republic of Estonia and a duty are applied to all users of Fragrance.ee and/or guests wishing to acquire our production.
• Fragrance.ee reserves the right to make changes to terms of sale and to change the prices. All changes are displayed on the site Fragrance.ee
• The goods presented on the Website can be acquired in case of their existence in a warehouse.
Coming into effect of the contract of sale
• Fragrance.ee sells, and the Client buys the goods offered in Online store.
• The contract signed between Fragrance.ee and the Client comes into force when the Client pays the specified sum on the settlement to the account of Fragrance Gallery OÜ after order confirmation.
• At registration of the order in Fragrance.ee Online store and at payment implementation the Client confirms that he examined terms of sale and agrees with them.
Prices
• All prices in Fragrance.ee Online store are specified in euro and include 20% of a sale tax.
• Fragrance.ee reserves the right to make changes in the prices. If the Client manages to pay for the order earlier, than the seller changed the price, the new price doesn't extend to
this Client in this case. Therefore the Client buys goods at that price which was specified on the site during registration of the order.
Registrations of the order and payment for goods
• The bank link (in an activation stage)
You can pay the order through the bank link. Now service is available to clients of Swedbank and SEB. To start payment by means of the bank link press the corresponding button near a logo of your bank, after order confirmation. Enter an Internet environment of bank and finish the completed payment order. After payment is executed, press the Return to the Seller button. On your email address the payment confirmation will be sent.
• Payment by a credit card (in an activation stage)
After the order is made, the client will be automatically redirected on the page of payment of a payment gateway of E-Commerce Payment Gatey on which it has to bring data of the card. E-Commerce Payment Gateway authorized transaction in bank, through the Nets Estonia AS company After input of number of the card, a code of safety and period of validity of the card, payment is made with the permission of bank of the client. When the system requests these cards, SSL, MasterCard SecureCode, Verified by Visa will be used for a guarantee of that exchange of information can't be copied or changed by strangers.
• The contract is considered signed and we start implementation of the order at once after the Client pays 100% cost of goods.
Delivery of goods
• Fragrance.ee completes the order and transfers it to the partners in the sphere of logistics after coming into effect of the contract of sale (after the Client pays the bill).
• The delivery period of goods specified on the site Fragrance.ee begins from the moment of payment.
• Prevention of delays and misunderstanding on delivery of goods depends on accuracy and correctness of the data presented in the order. Fragrance.ee doesn't bear responsibility for a delay and the misunderstanding which arose on delivery goods in that case when the delay and misunderstanding arose because at registration of the order the Client provided inexact data.
• The goods which were damaged during transportation (but not packing) are replaced with new goods to the Client. If there is no opportunity to replace the damaged goods with new ones, then we suggest to pay to the Client the cost of the damaged goods.
Right of returning goods
• On the basis of p.1 Art. 56 of the Obligations and legal law the client has a right of return goods within 14 days after receiving.
• The returned goods have to be unused, intact and be in original packing.
• The client incurs the expenses connected with return of goods (max. €10, on the basis of h. 4th Art. 194 of the Obligations and legal law). The exception is made in that case when discrepancy appears to the made order or defective goods become the reason of returning the goods.
• The client has to send the notice on the e-mail address: info@fragrance.ee with the desire to return goods, but no later than 14 days after receiving the goods. In the statement of return of goods it is necessary to enter a name of the Client, a product name and the reason of return.
• We pay to the Client compensation after checking the returned goods no later than within 10 calendar days after receiving goods.
Order of presenting of claims
• On the basis of the Obligations and legal law the Client has a right to make a claim to low-quality goods within 2 years from the moment of receiving goods, in case of detection of defect within the first six months of the specified term it is supposed that the goods were already on sale with defect. Nature of defect is defined by the seller.
• At defect emergence the Client is obliged to notify Fragrance Gallery, to send the letter to the e-mail address: info@fragrance.ee and also to specify the following inforiation: name, contact information and estimated defect. The corresponding statement has to be sent within 2 months after defect detection.
• Fragrance.ee doesn't bear responsibility for:
• arisen on fault or negligence of the Client of damage of goods
• the defects which arose when using goods not on purpose
• for natural physical wear of goods at its usual use.
Responsibility and force majeure
• Fragrance.ee bears responsibility before the Client, and the Client bears responsibility before Fragrance.ee in case of the arisen damage at violation of the real conditions by the
second party, agrees to the cases and scales established in the existing legal acts of the Republic of Estonia.
• Fragrance.ee doesn't bear responsibility before the Client for causing damage or a delay of delivery of goods in case the damage or a delay of delivery of goods are caused by
circumstances on which Fragrance.ee couldn't affect or provide.
Confidentiality
• When using of the site Fragrance.ee, the Client gives the accurate and considered consent of Fragrance.ee to processing of the personal data.
• Fragrance.ee undertakes to use the personal data provided by the Client only when filling the order of the Client and not to open them for the third parties.
Other conditions
• In case of disputes in the course of performance of these conditions, Fragrance.ee and the Client, first of all, try to come to a consensus by means of negotiations. The Client also has a right to address to Department of protection of the rights of the consumer or to Court if negotiations between Fragrance.ee and the Client didn't bring any results. In turn, Fragrance.ee also have a right to appeal to Court behind protection of the rights.
